RATTY DECISION
In reviewing all the FACTS of the issue at hand...we find that the racing officials were justified in reporting the violation to mwils1.....who levied the penalty on Ratty. We found that even if Ratty did communicate at times...several of the events that occurred which involved Ratty had a direct impact on the race....twice hittin g the #41 car and also hitting the #07 car....thus knocking that latter car out of the race. Race officials gave several warnings to Ratty and we do believe Ratty made an effort to heed the warnings. However...the penalty was levied more on overly aggressive driving then it was the lack of communication. Unfortunately for Ratty...he is victim of being party to precedence. As a result...I will reduce the penalty and decide the following.
Mwils - League Owner and Head Administrator
I will reduce the penalty to 1 position, 5 points and Probation for a period of 1 race. That would mean Ratty will finish 4th and TB drops back to 5th....HOWEVER...TB DOES NOT lose his fourth place points. Ratty will gain 4th place points. and there are no 5th place points. If Ratty stays clean and/or heeds race official warnings in the next race...he will regain his 5 points and come off of probation. However...If at any time over in the next race...Ratty is in violation of racing rules...and/or does not heed race official warnings...he will permanently lose his 5 points, be suspended for 1 race and placed back on probation for a period of 5 races. If Ratty violates rules while on 2nd probation...he will be suspended for the remainder of the season and his car will be taken away. Since this is a first offense...I consider this ruling a fair one and should set a precedence for all Nuff racers. Though we regret having to address this issue...we do feel it healthy for the quality of NRL.
